Damian is younger than in canon and doesn't arrive on Bruce's doorstep before he gets lost in time and is declared dead. Talia gives up on the hope of getting him out now that his father is gone, resigning herself to getting him out when he is older and capable of making it on his own.
Neither of them counted on Tim Drake being as awesome as he is and looking so protector-shaped in Damian's young eyes.

Sokka doesn’t even see Zuko move. One moment, he’s several feet away, twin dao raised in a ready stance, and the next, something is sweeping Sokka's legs from under him, and he’s hitting the dirt hard, a blade against his throat.
Zuko looks down at him from above, crowned in bright sunlight. His eyes are very gold.
Sokka can feel all his thoughts go bye-bye.
“I win,” says Zuko.
“Hng,” says Sokka.Distantly, he’s kind of proud of himself for getting out at least that much.

This is an important distinction, because adoption implies paperwork, consent, and a series of responsible adult decisions. None of those things have occurred. What has occurred is that Tim keeps showing up, and Bruce Wayne—international playboy, billionaire, and allegedly competent adult—has, on multiple occasions, failed to remove him.
This is not the same thing.
